Terms of Service
The agreement that governs your use of iFleetify Technologies products and services.
1 Acceptance of Terms
Welcome to iFleetify Technologies LLP ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our websites, products, and services including but not limited to iFleetify (Fleet Management System) and iLogitix (Multi-Tenant Transport Management System), collectively referred to as "Services".
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2 Description of Services
iFleetify
Real-time tracking, driver management, trip planning, and maintenance.
iLogitix
Multi-tenant TMS, LR lifecycle, POD, billing, and carrier integrations.
TECHNOLOGY PLATFORM ONLY:
iFleetify Technologies LLP is a technology provider only. We do not provide transportation, logistics, courier, or freight services. We are not a carrier, broker, or agent for any shipments. The accuracy of data entered into the system (e.g., weights, dimensions, LR details) is the sole responsibility of the User.
3 User Accounts & Security
3.1 Account Registration
- • Provide accurate and complete information
- • Keep credentials and API keys secure
- • Notify us of unauthorized access
- • Accept 100% responsibility for account activity
3.2 Prohibited Conduct
Reverse engineering, scraping, bypassing API limits, or sharing credentials for unauthorized profiling is strictly prohibited.
4 Intellectual Property
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, data compilations, and software, are the exclusive property of iFleetify Technologies LLP and are protected by Indian and international copyright and trademark laws.
5 Fees and Payment
You agree to pay all fees associated with your use of the Services as specified in your subscription plan or service agreement. All fees are non-refundable unless otherwise stated. We reserve the right to change our fees upon reasonable notice.
8 Limitation of Liability
8.1 Disclaimer
THE SERVICES ARE PROVIDED "AS IS". WE DO NOT WARRANT UNINTERRUPTED UPTIME OR ERROR-FREE OPERATION.
8.2 Third-Party Failures
We are NOT liable for outages/breaches caused by third-party integrations (WhatsApp API, SMS gateways, Payment Gateways like Razorpay/Cashfree, or Cloud Providers like AWS/Azure).
8.3 Liability Cap
Our total aggregate liability shall not exceed the fees paid by you in the preceding 12 months, or INR 10,000, whichever is higher.
11 Dispute Resolution
Multi-Step Process:
- 1. Informal Negotiation: Minimum 30 days.
- 2. Mediation: Mandatory 45 days.
- 3. Arbitration: Binding arbitration by a single arbitrator in Ahmedabad.
Governed by the laws of India, with exclusive jurisdiction in Ahmedabad, Gujarat.
